James Ferguson operates “Jim’s 11-E Auto Sales” in Jonesborough, Tennessee, as a sole proprietorship. In 1999, Consumers Insurance Co. issued a policy to “Jim Ferguson, Jim’s 11E Auto Sales” covering “Owned ‘Autos’ Onl.” Auto was defined to include “a land motor vehicle,” which was not further explained in the policy. Coverage extended to damages caused by the owner or driver of an underinsured motor vehicle. In 2000, Ferguson bought and titled in his own name a 1976 Harley-Davidson motorcycle, intending to repair and sell the cycle through his dealership. n October 2001, while driving the motorcycle, Ferguson was struck by an auto driven by John Jenkins. Ferguson filed a suit in a Tennessee state court against Jenkins-who was underinsured with respect to Ferguson’s medical bills-and Consumers. The insurer argued, among other things, that because the motorcycle was bought and titled in Ferguson’s own name, and he was driving it at the time of the accident, it was his personal vehicle and thus was not covered under the dealership’s policy. Voting Question: auto accident that happened almost a year ago?
I live in tennessee and about a year ago I rear ended someone and did not have insurance at the time. Her insurance company is threatening to sue for 8,000.00 and also say that I could lose my license until it is paid off. (I tried talking to them and offered to pay a 100.00 a month which is really more than I could afford and they said that although they will accept any payments I could make that wouldn’t stop them from sueing)Can anyone tell me what the statute of limitations is for this kind of lawsuit in the state of TN?
sometimes “people like me” have to decide between paying things like car insurance or feeding their children. I suppose I could always go on welfare and let “people like you” do it for me. And, no, the thought of the shoe being on the other foot doesn’t upset me because this girl drove around in a nice little rental car for four months because her bumper was squished, and daddy was footing her insurance bill for her..it’s “people like that”, that make me sick
Resolved Question: How much should I ask for in a personal injury auto accident?
The other driver is at fault and has state farm insurance.
I suffered a sprained ankle, broken arm at wrist (ulna) and have 3% whole body disability from a neck injury (has bone spur contributed to accident that causes neck and arm pain). I’m out approximately 3000$ in lost wages.
I was working at the time (driver) and it is workmans comp so vehicle repair and doctor bills are to be paid to my employer. My case is with the other driver in this case not work comp.
Please do not simply advise to get a lawyer.
Also I live in Tennessee so theres not many million dollar cases won here for these types of cases. I want to be fair anyway so that wouldn’t be something I would want. I also don’t want to sell myself short as I am soul bread winner for my family.
I’m going to try and get state farm to pay workmans comp there part so they won’t be coming to me for payment. Also thanks for the answers so far but as for the part about getting a lawyer I’m very aware of reasons to have one. I simply want all the info I can get up front as if I was handling it myself.
