A family member is being sued for a sum in excess of the limits of her auto insurance policy by a person who was not actually injured, but has incurred over 50,000 in medical bills as the result of a subsequent auto accident. The defendant (my family member) was not technically on the job but had arrived early to another city the preceding day in her own auto to conduct business the next day. The plaintiff’s attorney is seeking an amount in excess of the defendant’s auto insurance policy limits and has no assets except for a mortgaged primary residence (not an asset, in fact) and a small retirement account; the rest is debt.
