Voting Question: Does anyone have a suggestion on leverage over insurance companies?
My wife was hit from behind in an auto accident in which the other person was cited. The other persons insurance is already starting to play games and try to get away cheap on what they pay for. Imagine that!! In the past when I have dealt with insurance companies I’ve found that if the own insurance companies games cost them money it normally helps keep them focused on resolving the problem without as many games. The more games they play the more money it cost them.
Example: I either got them to arrange a rental car or inconvenience money for no car while mine was getting repaired.
My question is: Does anyone have other ideas on what an insurance company is obligated for in Florida so I can set it up and get some motivation from them on resolving this problem, thanks…..
Resolved Question: Head-on Collision, Auto Insurance question?
Obviously, this is a loaded question. But I need to ask.
Recently, my brother (in Florida) was hit head-on by what appears to have been an intoxicated driver. (I say “appears” because the toxicology reports haven’t come back yet. Yes, the other driver died at the scene. There are other details that lead us to think the driver was either drunk or on drugs. ) Either way, he crossed the line about 80 mph, hitting my brother head on.
My brother suffered bruises, cuts, broken toes, two herniated discs, and a broken arm. Also, the vehicle was totaled.
I know there’s no tried and true method of calculating insurance settlements. But I think I need to ask some things, somehow:
#1. Does my brother have the right to some sort of settlement? Obviously, he can’t sue the driver. I assume he can receive some compensation for pain and suffering from the Insurance company, in addition to medical bills?
#2. What type of settlement could he expect? Again, I know it depends on permanent injury. His attorney stated that broken bones can be considered permanent injury, and of course, the back pain won’t go away.
#3. Does the fact that the other driver was intoxicated or otherwise impaired lend anything to my brother’s case? Seems to me that it would, but maybe not?
